Katherine Jackson against the Estate Executors
Katherine Jackson has filed a sworn statement against the executors of her son’s estate for bringing a lawsuit against the Heal the world foundation: "Michael would be very upset, if he knew that our charity was being torn down by people who say they are doing what he wanted. Mr. Branca was a man that my son was very worried about. Michael told me on more than one occasion that he did not like this man and did not trust him, he told me that John had stolen from him. This lawsuit is exactly the type of awful thing that Michael said he was capable of doing."
John Branca, and John McClain, executors of Michael’s estate, filed a lawsuit against Melissa Johnson and the “Heal the World Foundation” because the Estate did not give permission for Michael Jackson’s name or likeness to be used by the charity. Michael Jackson had sued that "Heal the world foundation" because it was founded without his permission and was not linked to him in any way and indeed this is claimed even on the website. A judge declaired, therefore, that organization as fraudolent.
The "Heal the World Foundation" founded by Michael Jackson, officially closed its doors in 2002.
According to state records, the current "Heal the World Foundation" started in March 2008.

On August 11, 2009, CBS News reported that: "... representatives of the Jackson estate say the foundation is not linked, "The Michael Jackson estate has no connection whatsoever to the "Heal the World Foundation” run by Melissa Johnson," said Terry Fahn, a spokesperson for John Branca, the special administrator of the Jackson estate. On September 30, the Jackson Foundation started law action against the charity claiming that the "Defendants' acts of infringement and unfair competition have been committed with the intent to cause confusion, mistake and to deceive."

However, Katherine Jackson has hit back at the executors in a sworn statement.

TMZ reported this statement from the Executors: "We know that certain ludicrous statements were made recently that we won't personally dignify with a response. We will continue to do our best to uphold and further the memory and legacy of Michael with the same passion we have always held for him."
The case is scheduled to go to trial on Friday, April 29.
